Summarises the commencement order made under the Procurement Act 2023.
Welsh Ministers have given consent for the UK government’s Procurement Act 2023 (Commencement No. 4) Regulations 2025.
The table below summarises this commencement order made under the Procurement Act 2023 and provides the coming into force dates for the different sections.
It also makes the distinction between procurements regulated by Welsh Ministers and procurements regulated by UK government, i.e. reserved procurement arrangements.
UK government (UKG) has an earlier coming into force date for Section 69. Therefore, where a devolved Welsh authority has awarded a public contract under a reserved (non-devolved) procurement arrangement (i.e. an English framework or dynamic market) the first report for those in scope contracts will be required in April 2026.
Whilst Section 70 has not yet commenced in relation to procurements regulated by Welsh Ministers, the UKG’s commencement of Section 70 does apply to devolved Welsh authorities where the contract is awarded after 1 April 2026 under a reserved (non-devolved) procurement arrangement (i.e. an English framework or dynamic market) as these are covered by UKG regulations.
