ATISN 16045 – Request for Information.

Thank you for your request which I received on 1 February 2022 via the business’ RPW Online account.  You have requested the following:

‘You previously received information which states that 148 appeals had been overturned or partially overturned since 2015 but that none of the 148 cases relate to Glastir incompatible crop code cases upheld at Stage 1 of the appeals process.  Confirmation is now required that numerous panel findings have confirmed the rejection of an appeal against crop codes as stated by Hugh Morgan, but which contradicts the information provided in the Freedom Of Information of 14 September 2021.’

Our response

The 148 cases mentioned previously which were overturned or partially overturned related to all Stage 2 Appeals received regardless of scheme type between a time frame of 2015 to 2 September 2022.  The Appeals were overturned as a result of:

  • Revised Stage 1 Appeal decisions being issued following Stage 2 Appeal Unit investigations
     
  • or were withdrawn at the customer’s request
     
  • or further evidence was provided by the customer which resulted in the appeal being withdrawn.

In the email dated 4 August 2020 between Hugh Morgan and Gary Spiller, Hugh Morgan confirmed ‘I have seen numerous panel findings confirming the rejection of an appeal against crop codes.’  This is correct, Hugh Morgan was not specifying Glastir Scheme Crop code appeals, but was referencing appeals where all schemes have used incorrect crop codes.  All appeals relating to the use of incorrect crop codes have resulted in the appeals being rejected.
