Summary of outcome
Welsh Government received 72 responses to the recent consultation on the draft Regulations for Wales to support the implementation of the Liberty Protection Safeguards. A summary of these responses and a response from Welsh Government will be published later this winter.
UK Government are continuing to analyse responses to their recent consultation on the draft Mental Capacity Act 2005 Code of Practice for England and Wales, and draft Regulations for England. Welsh Government officials are working with UK Government to develop a response to the key issues raised within the consultations, identifying where changes are needed and whether these changes should be achieved through the Regulations for Wales or through the Code of Practice.
We want your views on the draft Regulations on the Mental Capacity (Amendment) Act 2019 and Liberty Protection Safeguards.
We are consulting on new regulations which will support the implementation of liberty protection safeguards (LPS).
The new LPS regulations will provide important rights and protections for people who lack the mental capacity to agree to care, support or treatment arrangements, where these arrangements amount to a deprivation of liberty.
