3. UK legal basis
The Welsh Ministers may, by virtue of s.31 of the Local Government Act 2003 (“the 2003 Act”), pay a grant to a local authority towards expenditure incurred or to be incurred by that Local Authority. Section 31(3) of the 2003 Act enables the Welsh Ministers to determine the amount of grant and s. 31(4) provides that the grant may be paid on such conditions as the Welsh Ministers determine. The Welsh Ministers have power to provide funding to RSLs under s. 18(1) of the Housing Act 1996 in connection with their housing activities. S.18(2) enables the Welsh Ministers to specify the procedure, circumstances, method and amount of grant that is paid.
4. Specific policy objectives of the scheme
To provide funding to Welsh Social Sector Landlords to undertake rapid remediation of identified fire safety defects in all in scope buildings (Social Sector Only, 11m+, As Built Fire Safety Defects) in order to protect the lives of residents.
The desired outcomes for the scheme are:
- Protection of life from fire-related harm
- Remediation of affected buildings to fire safety compliance
- Restoration of public and commercial confidence in the safety and viability of social sector MHRRB housing within Wales
- Appointment of specialist contractors that can using their expertise increase foundational economy in this sector in Wales.

Welsh Government.
6. Category(ies) of eligible enterprise
Welsh Registered Social Sector Landlords with in scope (11m+) residential housing.
7. Sector(s) to be supported
Construction.
8. Duration of the scheme
2020-2032. Closure of the scheme will depend on completion of works for the last award.
9. Budget for aid under the scheme
£128 million.
10. Form of support
All subsidy awarded under the scheme will be awarded by way of grants.
11. Eligibility terms and conditions
Key eligibility criteria:
- The fund is only open to registered social landlords and local authorities.
- It will support works to remediate as-built fire and structural safety issues within existing medium and high-rise residential buildings which are that are 11 metres and over in height (more than 4 storeys).
- Fire safety issues for the areas in scope are clearly based on an assessment of risk and measures integrated within the fire safety plan.
12. Basis for calculating subsidies
Each grant will fund 100% of eligible costs to approved applicants, paid in arrears.
13. Maximum subsidy allowable under the scheme
Individual awards are capped at £20 million.
