Ministerial Code requirement
Under the Ministerial Code, ministers must ensure that no conflict arises, or could reasonably be perceived to arise, between their public duties and their private interests, financial or otherwise.
On appointment to each new ministerial office, ministers are required to provide the Permanent Secretary with a written declaration of all interests that could potentially give rise to a conflict. The list should cover interests of the minister’s spouse or partner and close family which might be thought to give rise to a conflict.
The declaration process
Declarations by ministers, together with details of any action taken in relation to individual interests, are considered by the Permanent Secretary, in consultation with the Independent Adviser on Ministerial Standards, to determine whether any further action is required.
Ministers must notify the Permanent Secretary promptly and in writing of any change in circumstances. The Permanent Secretary will write to ministers on an annual basis, requesting they check that their existing record of private interests is complete and up to date.
Ministers’ declarations are treated as confidential. This enables ministers to provide full and frank disclosure, including information that may not ultimately be relevant to their ministerial responsibilities.
The published list
The published List of Relevant Ministerial Interests (the list) records details of interests current at the date of publication and may also include interests that ceased within the preceding years, depending on their context and relevance. Interests already declared in a minister’s Register of Interests in the Senedd are only included where they are directly relevant to the minister’s portfolio of responsibilities. The list should be read alongside the Register of Members’ Interests and any relevant information published by the Electoral Commission. Interests that have been disposed of, including those disposed of before appointment to ministerial office, may not appear in the list.
The list sets out interests held by ministers, or members of their close family, that are, or could reasonably be perceived to be, directly relevant to the minister’s official responsibilities. It also includes details of charities for which a minister acts as a trustee or patron. Ministers may have other associations with charities or non-public bodies - for example, through their role as a constituency Member of the Senedd. Such associations may be historic, inactive or no longer involve active participation.
The list is not a comprehensive record of all interests or financial arrangements held by ministers or members of their close family. To publish such information would represent an unjustifiable intrusion into their private affairs. Instead, the list is limited to those interests that are, or could reasonably be perceived to be, directly relevant to a minister’s public duties. Full declarations of all interests are retained by the Permanent Secretary.
Categories of interests disclosed
On appointment, ministers provide their interests in a number of categories:
- Personal information – ministers provide in confidence details of their address, date of birth and nationality.
- Financial interests – The list includes only financial interests directly relevant to a minister’s role, rather than every investment, loan or other interest they hold. It identifies any interests held in a blind trust or similar arrangement, where the minister neither manages nor knows which assets are held. This includes pensions, investment portfolios, liabilities, interests in family trusts and any public funding they or a close family member have received.
- Tax Affairs – Ministers are asked to confirm that their tax affairs are up to date and to declare any current or historic disputes with any tax authorities.
- Blind Trusts – Ministers are asked to declare and to give details of any blind trusts which they hold. Brief details of these will be included in the List. The list also provides information on ministers’ involvement with trusts that are not blind, for example certain family trusts if these are considered relevant to their role.
- Directorships and shareholdings – While ministers would not normally retain directorships while in office, in some specific circumstances it may be acceptable for a directorship to be retained, for example in connection with the management of a residential property or family enterprise, and subject to specific arrangements to avoid any conflict. In these circumstances details of these directorships will be included in the list. Shareholdings are not listed where they are considered to be de minimis in nature.
- Partnerships or other business interests – Ministers who are partners in a professional firm, such as a firm of solicitors or accountants, or in any other business must stop practising and take no part in its day-to-day management. Ministers must also record any relevant interests held by their spouse or partner, or by a close family member. Details of any business interests which are retained by ministers, and arrangements put in place to avoid a conflict, will be included in the List.
- Property – Ministers must declare any property owned wholly or partly by them or their spouse or partner. For each property, they must state whether it derives an income or if it is used solely by them or their family. They must also disclose any preferential rental or lease terms. Where a property generates rental income, ministers must confirm that it is registered with Rent Smart Wales, and it will be included in the list. In line with the Senedd Register of Members’ Interests, the List does not include property owned or occupied solely for a minister’s own or family use.
- Links with public organisations and charities – Ministers should declare any role they hold with any organisations or charities. These roles may include, but are not limited to, public appointment, patronages, members, presidents, vice-presidents, trustees, friends and any honorary roles. Ministers may have other associations not relevant to their ministerial Interests with charities or non-public organisations, for example, as constituency members. Such associations may be historic, lapsed or the minister may not be actively involved. Those roles which are considered relevant to their ministerial responsibilities will be included in the list.
- Trade Unions - Ministers must declare details of any trade union membership. Trade union membership of close family should also be included where it is relevant to a minister’s area of responsibilities. This information, however, is not usually shown in the list as it is classified as “special category data” under data protection legislation.
- Former employment – Ministers are required to provide details of previous employment held for the preceding 3 years, including details of the organisation and position held. Former roles which are considered relevant to their ministerial responsibilities will be included in the list.
- Any other relevant interests – Ministers must declare any other relevant interests, including those of close family members that could reasonably be perceived as conflicting with their ministerial responsibilities. Only interests that are directly and significantly relevant will be included in the list, balancing transparency with family members’ privacy and ability to work. “Close family” will be determined on a case-by-case basis. Ministers are not expected to know the affairs of every relative but should take reasonable steps where they have close and ongoing contact to meet their responsibilities under the Ministerial Code.
- Constituency Interests – In addition to declaring financial sponsorship, ministers may use this optional category to highlight specific projects, major employers or contentious issues in their constituency or within their ministerial responsibilities. Inclusion in the list will be considered on a case-by-case basis.
- Compliance with Legal Obligations – Ministers are asked to consider whether any aspect of their life may place them in breach of their duty to comply with the law. Consideration will be given on a case-by-case basis as to whether the information should be included on the list.
