How to use copyright material and report concerns about content on the PEDW website.

The material featured on this website is subject to Crown copyright protection unless otherwise indicated. You may use and re-use Crown copyrighted information featured in this website (not including logos) free of charge in any format or medium, under the terms of the Open Government Licence on the National Archive.

Planning and Environment Decision Wales (PEDW) does not check if material submitted to us satisfies copyright prior to publication. 

Where material is not clearly subject to Crown copyright protection or available under the terms of the Open Government License, it is your responsibility to determine and satisfy copyright and other use conditions before copying, submitting to PEDW transmitting, or making other use of the content.

Our logo

The use of our logo is restricted and may not be used by other individuals or organisations without formal permission from us. To seek permission to use our logo, e-mail brandingqueries@gov.wales.

Notice and Takedown policy

In making material available online PEDW acts in good faith. However, despite these safeguards, we recognise that from time to time material published online may be in breach of copyright laws, contain sensitive personal data, or include content that may be regarded as obscene or defamatory. If you are concerned that you have found material on our website, for which you have not given permission, contravenes privacy laws, is obscene / defamatory and in terms of copyright law is not covered by a limitation or exception, please contact us at PEDW.Casework@gov.walesstating the following:

  • Your contact details.
  • The full details of the issue.
  • The case reference and document name.
  • If the request relates to copyright, provide proof that you are the rights holder and a statement that, under penalty of perjury, you are the rights holder or are an authorised representative.
  • The reason for your request including but not limited to copyright law, privacy laws, data protection, obscenity, defamation etc.

Upon receipt of notification our ‘Notice and Takedown’ procedure will then be invoked as follows:

  1. PEDW will acknowledge receipt of your complaint and will make an initial assessment of the validity of the complaint.
  2. Upon receipt of a valid complaint the material will be temporarily unpublished pending an agreed solution.
  3. PEDW will contact the contributor who deposited the material, if relevant. The contributor will be notified that the material is subject to a complaint, under what grounds, and will be encouraged to assuage the complaints concerned.
  4. The complainant and the contributor will be encouraged to resolve the issue swiftly and amicably and to the satisfaction of both parties, with the following possible outcomes:
    • The material is re-published unchanged.
    • The material is re-published with changes.
    • The material is permanently removed from PEDWs Planning Casework portal and systems.
  5. If the contributor and the complainant are unable to agree a solution, the material will remain unavailable through the PEDW’s Planning Casework Portal until a time when a resolution has been reached.
