Privacy notice for the Survey of Chairs of public bodies in Wales.

Introduction

We are conducting a survey to gather information about the publication of Board and Audit Committee minutes and actions to deliver anti-racism by Regulated Public Bodies’ boards. This supports the Welsh Government’s commitment under the Anti-Racist Wales Action Plan to work with senior leaders to drive anti-racism.

The information will be collected by the Leadership & Governance team in the Public Bodies Unit. The Welsh Government is the data controller for the research. We will not share individual responses with others in Welsh Government unless you ask us to do this. We will use the individual responses to produce two reports. One will include aggregated data on the publication of board minutes and the other will include aggregated data on anti-racism objectives. This will not identify any individual boards but we will produce analysis by the following groups – NHS/health boards, Commissioners, Culture ALBs and other ALBs. The report on anti-racism objectives will be used to help us demonstrate that we have met actions in the Anti-racism Wales Action Plan and we will share both the reports with our networks of Chairs and Chief Executives.

What personal data do we hold and where do we get this information?

Personal data is defined under the UK General Data Protection Regulation (UK GDPR) as ‘any information relating to an identifiable person who can be directly or indirectly identified by reference to an identifier’.

You have been sent this survey as a web link. We already hold your contact details as you are a member of the Chairs’ network.  These contact details are not covered by this privacy notice.  

As part of this research we will be collecting the following personal data: 

  • Regulated public body 
  • Your role in the public body

You do not have to answer every question. If you do not wish to take part or receive reminders, please reply to the representative who sent you the survey link.

What is the lawful basis for using your data?

The lawful basis for processing information in this research is our public task; that is, exercising our official authority to undertake the core role and functions of the Welsh Government. 

Research such as this is important for the Welsh Government to collect information and actionable evidence about its ability to deliver government priorities. 

How we use your data

The information collected will be used to:

  • Assess the consistency of approach to the publication of minutes.
  • Shape future guidance and actions.
  • Enable Senedd scrutiny.
  • Provide public insight into the take-up of guidance and actions in the Anti-racism Wales Action Plan.

All analysis will be conducted in aggregate form. No individual will be identifiable in reports.

How secure is your personal data?

Personal data provided to Welsh Government is held on secure servers, and for this project a folder has been created that has access restricted only to the Leadership & Governance team. The data you provide will be stored in this restricted folder. Personal information stored in this folder will not be shared outside of the team. 

When conducting surveys, the Welsh Government uses a survey software programme called Smart Survey. We have ensured that Smart Survey is UK GDPR compliant and meets our expectations in terms of the security of any data collected via the software.

How long do we keep your personal data?

Individual survey responses, which includes personal data, will be deleted by the Welsh Government’s Public Bodies Unit within two years of the report’s closure date. This will enable the team to follow up on any comments made in the report. Survey responses will only be used for research analysis. The final report will not contain any personal data and all responses in the final report will be aggregated. 

Individual rights

Under UK GDPR, you have the following rights in relation to the personal information you provide as part of this research, specifically you have the right:

  • To access a copy of your own data; 
  • For us to rectify inaccuracies in that data;
  • To object to or restrict processing (in certain circumstances);
  • For your data to be ‘erased’ (in certain circumstances); and
  • To lodge a complaint with the Information Commissioner’s Office (ICO) who is our independent regulator for data protection.
