Introduction
In accordance with the UK General Data Protection Regulation and Data Protection Act 2018, this notice sets out how we will process your personal data.
Personal data is any information about a living individual that can be used to identify them, for example, their name, address, date of birth, email address or qualifications. The people who control your personal data will be the staff of the Welsh Tribunals Unit which is a department within the Welsh Government (WG).
The type of personal information we collect
We currently collect and process the following information: personal and special category information such as name, address, date of birth, national insurance number.
How we get the personal information and why we have it
We will collect your personal data in a number of ways, for example:
- Judicial Appointments Commission will provide it when you are recommended for appointment
- You provide it when accepting appointment
We use the information that you have given us for the following purposes:
- to pay your fees, travel and subsistence
- for pension purposes
- any other legitimate reasons that relate to your appointment
We may share this information with:
- Welsh Tribunals
- HMCTS
- eJudiciary (for your eJudiciary account)
- Judicial College (for your training)
- Ministry of Justice
- Judicial Office
- Payroll for Welsh Government
- Payroll provider (currently Liberata)
- Pension provider (currently XPS for legal members / NEST for non-legal members)
- Other UK & Welsh Government Departments
We may also share your data with other organisations from time to time if we are under a legal obligation to do so. Under the UK General Data Protection Regulation (UK GDPR), the lawful basis we rely on for processing this information is: (e) We need it to perform a public task.
How we store your personal information
Your information is securely stored.
We will keep your data while you are a member of a Welsh Tribunals. When you are no longer a member, we will keep your information for no longer than necessary in line with the review dates in our retention and disposal schedule. Your personal information will be disposed of securely once the retention period has ended.
What rights do I have?
- You have the right to obtain confirmation that your data is being processed and to have access to your personal data
- You are entitled to have personal data rectified if it is inaccurate or incomplete
- You have a right to have personal data erased and to prevent processing in certain circumstances
- You have the right to ‘block’ or suppress processing of personal data in certain circumstances • You have the right to data portability in certain circumstances
- You have the right to object to the processing in certain circumstances
