Legal fees for Listening to People: NHS Wales complaints, incidents and redress process

This framework sets out the fees that may be paid to independent legal representatives by Welsh NHS bodies, in line with Listening to People: the NHS Wales complaints, incidents and redress process.

All fee categories are mutually exclusive and should not be added together across stages. Fees relating to an Infant Approval settlement are separate.

All figures are shown before VAT.

£1,750

This fee covers legal advice where a qualifying liability has been admitted. It includes obtaining joint reports from up to 2 experts and advising on those reports.

If additional expert reports are required (with prior agreement), an extra £438 may be paid.

£1,000

This fee covers legal advice on the amount of damages where a settlement is reached under the redress arrangements. It includes commissioning joint reports from up to 2 experts and advising on those reports.

If additional expert reports are required (with prior agreement), an extra £438 may be paid.

£875

This fee applies where a qualifying liability has been admitted but no financial offer is made. It covers legal advice on the refusal to make an offer.

£1,094

This fee covers the approval process, including any approval hearing. This applies to all cases where an approval hearing is required, including cases involving:

• children
• patients who lack capacity

In addition, the Welsh NHS body will pay:

• court fees (as charged)
• counsel fees (with justification of costs), typically between £500 and £900
