How we will handle any personal data you provide in relation to Welsh Building Safety Fund.

Background

The Welsh Building Safety fund allows Responsible Persons (e.g. building owners/ managing agents) to access support from the Welsh Government, who will carry out building safety related surveys on their behalf.

This approach is considered essential to establish consistent survey information, which will help us understand the scale and nature of problems.  This approach will also help prioritise next steps on a risk basis and enable us to better plan and understand the support required. It will also provide much-needed clarity to residents and building owners and give them confidence in the quality of the survey outcomes.

The Expression of Interest process is the first step to access support from the Welsh Government.  During this process, Responsible Persons submit information necessary to demonstrate eligibility and further details that will allow our contractors to make an initial assessment of the building.  Where appropriate, this information will indicate the need for a further intrusive investigation, which will be carried out by the Welsh Government appointed consultants, at no cost to the Responsible Person.

Data Controller

The Welsh Government is the data controller for information collected by Building Safety networks. The establishment and work of the Building Safety networks contributes to the Welsh Minister’s discharge of their duty regarding the Building Safety Programme agenda.

The lawful basis for collecting this information is Article 6(1)(e) – task in the public interest.

What do we do with your information?

In our remit as the data controller, the Welsh Government uses the information purposes below;

  • To contact Responsible Owners to update them on the Expression of Interest process.  
  • To provide updates and information via mailing lists on building remediation activities.

Who do we share your information with?

Information will only be shared with our specialist contractor to evaluate the expression of interest.

Personal information processed by Welsh Government is protected within our secure IT systems and will only be accessible to relevant authorised staff members .

How long will we keep your information?

Welsh Government Building Safety team will keep the information regarding a building indefinitely and the responsible persons details for a period of 2 years or until an individual informs them, they no longer wish to participate or the workstream comes to an end. All personal information will be deleted in line with Welsh Government’s information retention policy.

Your rights in relation to your information

Under the data protection legislation, you have the right:

  • to access the personal data that Welsh Government process about you
  • require us to rectify inaccuracies in that data
  • to (in certain circumstances) object to or restrict processing
  • To (in certain circumstances) your data to be ‘erased’
  • to lodge a complaint with the Information Commissioner’s Office (ICO) who is our independent regulator for data protection.
